David received his bachelor's degree from North Carolina State University and his law degree from the Appalachian School of Law. He is married with a son and his family attends Garber United Methodist Church.

David previously worked as a partner of the Valentine and McFadyen Law Firm, as a private attorney for the Kellum Law Firm in New Bernwhich.

W. David McFayden currently serves as the District Court Judge in Judicial District 3B. He was first elected in 2012 and is serving his third term.

As a district court judge, McFayden oversees all felony, probate, and civil cases, rules in all civil actions against the state seeking financial payment, authorizes naturalization procedures, and exercises authority to review and correct the rulings of lower courts.

As a private attorney, McFayden practiced criminal, juvenile, and civil law. He said that he took "great pride in his work with juvenile and indigent clients, and work[ed] diligently to ensure they, like the rest of the clients he serve[d], receive[d] quality representation."

Community Involvement

- District Court judges hear civil, criminal, and juvenile cases. Civil cases dealing with divorce, child custody, and child support are heard in District Court. 
- Under the District Court, the magistrate can try small claims cases ($10,000 or less), landlord eviction cases, and suits for recovery of personal property. A magistrate is an independent judicial officer, recognized by the North Carolina Constitution as an officer of the district court. 
- District Court Judges are elected for a four-year term. Elections are partisan.
